Warranty
Tail Feather Camper Kits and components come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.
Micky Booth (Franchising) Pty Ltd (ABN 19 103 527 117) trading as Micky Booth RV of 14 Eugene Terrace, Ringwood VIC 3134 provides the following warranty in relation to its Tail Feather Camper Kits.
The benefits of this warranty are in addition to any rights and remedies imposed by Australian State and Federal legislation that cannot be excluded.
1. Subject to the term and conditions below, Micky Booth RV warrants to the original purchaser that for a term of 12 months from the date of purchase, all parts of the manufacture and assembly of the camper kits carried out by Micky Booth RV that are defective in workmanship or materials will be repaired or replaced without charge to the original purchaser.
2. In the event of a claim within the warranty term, the purchaser should contact Micky Booth RV on 1300 133 109 or 0425 857 866 prior to carrying out any repair or rectification. It is the responsibility and obligation of the purchaser to notify Micky Booth RV immediately a fault becomes apparent. Any claim for reimbursement for repairs carried out without prior authorization will be denied and the warranty may be void if the purchaser continues to use the camper kit once the defect is apparent.
3. Original proof of purchase of the camper kit or receipt will be required for any warranty claim to be considered. The proof of purchase and any other paperwork request by Micky Booth RV should be forwarded to: 14 Eugene Terrace, Ringwood, VIC 3134 Email: [email protected]
4. In the event of a claim, it is the purchaser's responsibility to deliver the camper kit component to Micky Booth RV for inspection and testing. Any cost or expenses incurred by the purchaser in making a claim or in complying with the purchaser's obligations under this warranty shall be the purchaser's responsibility. This includes any postage, courier charges or travelling time which may be required to return the component to Micky Booth RV. If a fault is detected, the component presented for repair may be replaced by refurbished goods of the same type rather than being repaired. Refurbished parts may be used to repair the goods.
5. This warranty does not cover failure caused by or related to:
(a) normal wear and tear commensurate with age and use,
(b) accident damage, off-road use and water submersion,
(c) owner abuse or damage caused by incorrect assembly of components, or incorrect, or inadequately securing the camper kit to the trailer (if used as a mobile camper),
(d) failure to comply with instructions contained in the Owner's Manual,
(e) any alteration or modification of the camper parts, or
(f) abnormal environmental conditions, including, but not limited to, tropical cyclones, fire, flooding, road salt, and humidity.
Nor does this warranty apply to parts made out of cloth, leather, wood, paint, or chrome, which have been affected by airborne fallout, including, but not limited to, chemicals and tree sap.
6. No warranty is given for defects or damages caused by repairs, alterations and modifications by the purchaser, or anyone other than Micky Booth RV.
7. Appliances and equipment which are not manufactured by Micky Booth RV (for example the trailer and all of its components, awnings, annexes, 12 volt battery, battery box, battery charger, 12 volt power panel, electrical leads, curtains, sun shields, and marine carpet) are covered by any warranty issued by the manufacturer of such items for the term offered by the manufacturer of such items. Micky Booth RV offers no warranty on these items and the cost of removal and replacement of such items for the purpose of repair is the purchaser's responsibility.
8. The Tail Feather Camper Kit is designed to be assembled on a trailer to create a 'camper' or on the ground or raised platform to create a 'shelter'. Micky Booth RV is not responsible for the assembly of the kit, however Micky Booth RV will provide assistance and pre-assembly training at 14 Eugene Terrace, Ringwood, VIC 3134 for those who purchase a trailer through one of our trailer manufacturers.
9. The purpose of the pre-assembly training is for Micky Booth RV to explain and demonstrate all the fixtures and fittings of the camper kit, and for the purchaser to acknowledge that all items fitted and supplied are as ordered, and in working order at the time of delivery.
10. Assistance and pre-assembly training will also be offered at 14 Eugene Terrace, Ringwood, VIC 3134 to those wishing to assemble the kit on their own trailer providing the trailer is in a safe and road worthy condition as determined by Micky Booth RV. Micky Booth RV reserves the right to refuse assembly assistance if they believe the camper kit is to be assembled on an unsuitable trailer.
11. For those purchaser's that have their camper kit delivered by courier, Micky Booth RV does not know the purpose you have in mind for your Tail Feather Camper Kit nor does Micky Booth RV know the Gross Vehicle Mass of the trailer you intend assembling your Camper Kit on. Therefore, Micky Booth RV makes no warranties or representations, express or implied, as to the performance of your vehicle with the Camper or whether the match-up of your vehicle and Camper exceeds the ATM or towing capacity as specified by your vehicle's manufacturer. Specifically, there is no express or implied warranty of merchantability or of fitness for the particular match of your vehicle or application to any particular camper or shelter.
12. This is the only warranty issued by Micky Booth RV to the purchaser, and excludes any oral or written warranty given by any dealer or agent of Micky Booth RV.
13. The repair or replacement of the camper kit or part of the camper kit is the absolute limit of Micky Booth RV's liability under this express warranty.
14. This warranty is issued to the original purchaser, and is not transferable.
